Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of the Modi mobile app (the "App") and the Modi website. The Modi mobile app (iOS and Android) and the website at tidemobileapp.com/modi are operated by an individual developer based in Adana, Türkiye, doing business under the TideMobile brand. In this document, "TideMobile", "we", "us" and "our" refer to this developer.

By downloading, creating an account in or using the App, you agree to these Terms. If you do not agree, do not use the App. Our Privacy Policy explains how we process personal data. The Turkish version of these Terms is available here; for users in Türkiye the Turkish version prevails.

2. Nature of the service and health disclaimer

Modi is a self-care app designed to support emotional awareness and personal growth. It offers AI-assisted chat, a mood calendar, meditations, self-assessment tests, guided journeys, a reading corner and community features.

3. Eligibility and account

• You must be at least 13 years old to use Modi. If you are between 13 and 18, you may use Modi only with the permission of a parent or legal guardian.
• Provide accurate information and keep your login details confidential. You are responsible for activity on your account.
• Your account is personal and may not be transferred, sold or shared.
• Tell us immediately at tidemobile.contact@gmail.com if you believe your account has been used without permission.

4. AI chat

• Chat replies are generated automatically using Google's Gemini model and may be inaccurate, incomplete or unsuitable for your situation.
• Do not rely on AI replies for health, legal, financial or safety decisions; consult a qualified professional.
• Modi is designed to direct you to professional help in risky situations, but it is not guaranteed to detect emergencies.
• The free version has a daily chat limit. Reasonable usage limits may apply to all users to prevent abuse.
• You may not use the chat to create unlawful or harmful content or to try to bypass its safety rules.

5. Community guidelines

The Modi community is meant to be a safe, supportive space. The following are strictly prohibited, and we have zero tolerance for objectionable content or abusive users:

• Hate speech, discrimination, insults, harassment, bullying or threats of violence;
• Sexual content and any content related to child exploitation;
• Content that encourages, instructs or promotes self-harm or suicide;
• Sharing your own or other people's personal data;
• Advertising, spam, misleading links or commercial content;
• Content presented as medical advice or misleading health information;
• Unlawful content or content that infringes others' intellectual property.

You can report content with the "Report" option and block users who bother you. Reported content is reviewed within 24 hours; content that breaks the rules is removed and the user may be restricted or removed. You are responsible for what you post, and you grant TideMobile a limited, non-exclusive, royalty-free permission to host and display your posts within the App. This permission ends when the content is removed.

6. Modi Premium subscription

Modi's core features are free. Modi Premium is an optional, auto-renewing subscription with monthly and yearly plans. Current prices, including applicable taxes, are shown in the App Store or Google Play at the time of purchase and may vary by country.

• Payment is charged by the store you purchase from (Apple App Store or Google Play), which acts as merchant of record.
• Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period; renewal is charged within 24 hours before the period ends.
• Free trials may be offered; the trial length is shown on the purchase screen. If you do not cancel before the trial ends, the paid plan starts. Cancelling during the trial means you are not charged.
• Cancel on iOS: Settings > [your name] > Subscriptions > Modi > Cancel Subscription. Cancel on Android: Google Play > Profile > Payments and subscriptions > Subscriptions > Modi > Cancel subscription.
• After cancelling, Premium remains active until the end of the paid period. Deleting your account does not cancel your subscription.
• Refunds are handled under the refund policy of the store you purchased from (Apple: reportaproblem.apple.com; Google Play: Payments and subscriptions). Statutory consumer rights in your country are not affected.

7. Virtual items (fish)

Fish, XP and virtual items earned in the App are personal, non-transferable and valid only inside the App. They have no monetary value, cannot be exchanged for money and are not refunded when an account is deleted or closed. Suspended Fish donations cannot be reversed.

8. License and intellectual property

TideMobile grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, in line with the rules of the store you downloaded it from. The App, the Site, the Modi character, artwork, texts, journeys, meditations and all other content belong to TideMobile or its licensors and are protected by intellectual property laws. You may not copy, distribute, modify, reverse engineer or create derivative works from them.

You may not attempt to bypass security, access our systems without authorization, disrupt the service, collect data with automated tools, create fake accounts, abuse reward systems or use the App unlawfully.

9. Disclaimer and limitation of liability

Modi is provided "as is" and "as available" without warranties of uninterrupted or error-free operation, to the extent permitted by law. To the extent permitted by law, we are not liable for indirect or consequential damages or lost profits, and our total liability is limited to the subscription fees you paid for Modi in the 12 months before the claim arose. These limits do not apply to liability for intent or gross negligence or to any liability that cannot be limited under mandatory law, and they do not affect your statutory consumer rights.

10. Account deletion and termination

You can delete your account at any time in the App or as described on the Account and Data Deletion page. We may suspend or close accounts for serious or repeated breaches of these Terms, unlawful use or behavior that threatens other users. You can appeal by emailing tidemobile.contact@gmail.com.

11. Changes

We may update these Terms. The current version is published on this page with its last updated date. We will announce material changes (such as prices, your rights or the scope of data processing) at least 30 days before they take effect. If you do not accept them, you may cancel your subscription and delete your account during that period.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer living elsewhere, the mandatory consumer protection laws of your country of residence still apply and you may bring claims in the courts available to you under those laws.

13. Apps downloaded from the Apple App Store

• These Terms are between you and TideMobile only, not Apple Inc. ("Apple"). TideMobile, not Apple, is solely responsible for the App and its content.
• Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• TideMobile is solely responsible for maintenance and support. Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• TideMobile, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection claims.
• TideMobile, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you.

14. Apps downloaded from Google Play

If you downloaded the App from Google Play, Google is not a party to these Terms. The Google Play Terms of Service and related Google policies also apply to your use.
